1. Sobre esta política

O Mapa do Swing respeita os direitos autorais de terceiros e responde a notificações de suposta violação conforme o Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512, e a legislação brasileira aplicável (Lei nº 9.610/1998 e Marco Civil da Internet, Lei nº 12.965/2014).

O site é um agregador de informação: divulga a programação de casas liberais e produtores. Imagens de capa, logotipos e descrições podem ter sido fornecidos pelos próprios estabelecimentos ou obtidos de suas páginas públicas de divulgação. Se você é titular de direitos sobre algum material publicado aqui e não autorizou seu uso, siga o procedimento abaixo — o conteúdo será removido.

2. Agente designado

3. Como enviar uma notificação

Para que a notificação seja válida, inclua todos os itens abaixo (exigidos pelo 17 U.S.C. § 512(c)(3)):

1. Assinatura, física ou eletrônica, do titular ou de seu representante autorizado.
2. Identificação da obra protegida que você alega ter sido violada.
3. Identificação do material a ser removido, com o endereço (URL) exato da página onde ele aparece no site.
4. Seus dados de contato: nome completo, endereço, telefone e e-mail.
5. Declaração de que você acredita de boa-fé que o uso não foi autorizado pelo titular, por seu representante ou pela lei.
6. Declaração de que as informações são exatas e, sob pena de perjúrio, de que você é o titular ou está autorizado a agir em seu nome.

Notificações incompletas podem atrasar a análise. Ao receber uma notificação válida, o material é removido ou desabilitado em prazo razoável, e a parte que o publicou é informada quando aplicável.

4. Contra-notificação

Se o seu material foi removido e você acredita que houve engano ou identificação incorreta, envie uma contra-notificação ao mesmo e-mail, contendo: sua assinatura; identificação do material removido e onde ele aparecia; declaração, sob pena de perjúrio, de que a remoção resultou de engano; e seu nome, endereço e telefone.

5. Reincidência

O Mapa do Swing encerra a divulgação de estabelecimentos, produtores ou colaboradores que violem direitos autorais de forma reiterada.

6. Uso indevido do procedimento

Notificações falsas têm consequências legais. Quem declara falsamente que um material viola direitos autorais pode responder por perdas e danos, incluindo custas e honorários, conforme o 17 U.S.C. § 512(f).

Mapa do Swing respects the intellectual property rights of others and responds to notices of alleged copyright infringement in accordance with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512, and applicable Brazilian law.

This website is an information aggregator that lists events held by adult venues and promoters in Brazil. Cover images, logos and descriptions may have been supplied by the venues themselves or collected from their public promotional pages. If you own rights to material published here and did not authorize its use, follow the procedure below and the content will be removed.

3. Filing a notice

To be effective, a notification must include all of the following, as required by 17 U.S.C. § 512(c)(3):

1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
2. Identification of the copyrighted work claimed to have been infringed.
3. Identification of the material to be removed, including the exact URL where it appears on this website.
4. Your contact information: full name, address, telephone number and e-mail address.
5. A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law.
6. A statement that the information is accurate and, under penalty of perjury, that you are the owner or authorized to act on the owner's behalf.

Incomplete notices may delay review. Upon receiving a valid notice, the material is removed or disabled within a reasonable time, and the party who published it is notified where applicable.

4. Counter-notification

If your material was removed and you believe it was due to a mistake or misidentification, send a counter-notification to the same e-mail address including: your signature; identification of the removed material and where it appeared; a statement under penalty of perjury that the removal resulted from a mistake; and your name, address and telephone number.

5. Repeat infringers

Mapa do Swing terminates the listing of venues, promoters or contributors who repeatedly infringe copyright.

6. Misuse of this procedure

False notices carry legal consequences. Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing may be liable for damages, including costs and attorneys' fees.
